Cyber law and technology law research in India has more live material than ever: the Digital Personal Data Protection Rules, 2025 phasing in to May 2027, the February 2026 IT Rules amendments on synthetic content, the India AI Governance Guidelines, the Online Gaming Act, 2025 and the first Indian ruling on AI training and copyright. Below are specific topics grouped by area, plus advice on narrowing and sources.
Data protection and privacy
The DPDP Rules were notified on 13 November 2025. Rules on the Data Protection Board applied at once; consent manager provisions apply after 12 months; most data fiduciary obligations apply after 18 months, from 13 May 2027.
- Consent managers: A new regulated intermediary that holds consent on behalf of users. What liability should it carry when consent is mis-recorded?
- State exemptions: Do the broad exemptions in Section 17 of the DPDP Act, 2023 meet the legality, necessity and proportionality test from K.S. Puttaswamy (2017)?
- RTI and privacy: The DPDP Act amends Section 8(1)(j) of the RTI Act, 2005 to exempt personal information more broadly. What is the cost to transparency in public appointments and spending?
- Children’s data: Verifiable parental consent under the Rules. Is age assurance possible without collecting more data?
- No compensation for victims: The Board imposes penalties, but the Act does not give data principals compensation. Should Section 43A of the IT Act have been retained?
- Independence of the Data Protection Board: Appointment and removal by the Centre. A comparison with GDPR supervisory authorities.
- Cross-border transfers: The negative-list approach and sectoral localisation by RBI and others. Which rule wins in a conflict?
Platform regulation and free speech
- Synthetic content: The IT Amendment Rules notified on 10 February 2026 define synthetically generated information, require labels and metadata, and cut some takedown timelines to three hours. Is a three-hour window compatible with reasoned decision-making?
- Provenance metadata: Can embedded identifiers serve as evidence of authenticity under Section 63 of the Bharatiya Sakshya Adhiniyam?
- Sahyog portal: The Karnataka High Court dismissed X Corp’s challenge in September 2025. Should notices under Section 79(3)(b) carry the safeguards of Section 69A and Shreya Singhal (2015)?
- Fact-check units: After the Bombay High Court struck down the 2023 fact-check amendment, can government-identified “fake news” be regulated at all?
- Safe harbour after AI: Is a generative AI tool an intermediary under Section 2(1)(w) of the IT Act?
Artificial intelligence governance
- Principles or statute? MeitY released the India AI Governance Guidelines in November 2025, favouring existing laws and voluntary measures over a new AI Act. Is this approach enough for high-risk uses?
- AI in public decisions: When a welfare or tax decision is made with an algorithm, how does the duty to give reasons apply?
- Liability for AI harm: Product liability under the Consumer Protection Act, 2019 or negligence? A framework for Indian courts.
- AI in courts: Guidelines for judicial use of generative AI, transcription and translation tools.
- Facial recognition by police: Legal basis, accuracy and proportionality.
AI and intellectual property
- In July 2026 the Delhi High Court refused ANI an interim injunction against OpenAI, holding prima facie that storing works for training fell within Section 52(1)(a). How far can that reasoning extend beyond news content?
- DPIIT’s December 2025 working paper proposes a hybrid model with a mandatory blanket licence for AI training. Who should set royalties, and how?
Online gaming, fintech and cybercrime
- Online Gaming Act, 2025: The Act bans online money games and the Rules took effect on 1 May 2026. Is a total ban proportionate under Article 19(1)(g)?
- Digital arrest scams: Do the BNS cheating and impersonation provisions fit, or is a specific offence needed?
- UPI fraud liability: Who bears loss under RBI’s limited liability framework when the customer is socially engineered?
- Cyber forensics: Chain of custody for digital evidence under the BNSS.
- Telecommunications Act, 2023: Interception and suspension powers after Anuradha Bhasin (2020).
How to narrow a technology law topic
- Name the instrument and the rule. “AI regulation” becomes “labelling duties of significant social media intermediaries under the 2026 IT Rules amendment”.
- Pick a harm or a right. Privacy, speech, consumer loss, discrimination or competition.
- Watch the dates. Many obligations are phased. Say clearly whether a provision is in force on your submission date.
- Limit comparison. One foreign system (EU, UK or Singapore) is usually enough.

Worked example
| Stage | Version |
|---|---|
| Broad | Deepfakes |
| Narrower | Takedown timelines for synthetic content |
| Research question | Can a three-hour compliance window under the 2026 IT Rules amendment coexist with notice, reasons and review as required by Shreya Singhal? |

Frequently asked questions
Is the DPDP Act fully in force?
Not fully. The Rules phase in over 18 months from 13 November 2025, with most compliance duties applying from 13 May 2027. Always state which provisions apply on the date you write.
Does India have an AI law?
There is no dedicated AI statute as of late 2026. AI is governed through the IT Act and Rules, the DPDP framework, sectoral rules and the 2025 AI Governance Guidelines.
Is ANI v. OpenAI a final decision?
No. The July 2026 ruling refused an interim injunction on a prima facie view. The suit continues, so treat its reasoning as provisional.
How technical should a technology law paper be?
Explain the technology in plain words, only to the extent your legal argument needs it, and cite reliable technical sources for any factual claims.
